By reserving a yacht or using our Service, you consent to these Terms. If you do not agree with any section of these terms, you are prohibited from using the Service.
2. Service Overview
OpenAccessPlaza offers high-end yacht charter services that include, but are not limited to:
- Day-long yacht hire
- Evening boat tours
- Company excursions
- Exclusive gatherings
- Extended sailing trips
Service availability is contingent on weather conditions. We maintain the authority to alter or terminate services at our discretion.
3. Booking and Reservations
3.1 Booking Process
For charter booking, you are required to:
- Be not younger than 18 years
- Submit precise and complete information
- Make the specified initial payment detailed in the booking confirmation
- Accept these Terms & Conditions
3.2 Confirmation
A booking becomes valid once payment has been made and our written confirmation is received. We retain the right to deny service to any individual as per our judgement.
3.3 Availability
Charter reservations are reliant on vessel availability and favorable weather conditions. We will strive to meet your preferred scheduling.
4. Payment Terms
4.1 Pricing
All costs are listed in £ and incorporate all taxes unless stated otherwise. Price points are changeable without prior notice.
4.2 Payment Schedule
- The initial deposit: 50% of the total cost of the charter due at the time of booking
- Full payment: Due 48 hours before the charter departs
- Supplementary charges (if applicable): Due at the conclusion of the charter
4.3 Payment Methods
We accept major credit cards, wire transfers, and certified checks. Payment processing is executed through secure, encrypted systems.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- If canceling more than 72 hours before departure: A full refund minus processing fees
- If canceling within 24 to 72 hours of departure: A 50% refund
- If canceling less than 24 hours before departure: No refund is given
5.2 Weather Cancellations
Should our captain deem weather conditions unsafe, we will propose to:
- Reschedule the charter at another time without additional costs
- Issue a full refund if rescheduling cannot be arranged
5.3 Mechanical Issues
Should there be a mechanical failure with the designated vessel, we will attempt to offer an appropriate substitute. In the absence of such, a complete refund will be issued.
6. Safety and Conduct
6.1 Safety Requirements
All guests must:
- Adhere to all instructions from the crew
- Utilize safety gear when necessary
- Disclose any health conditions that could impact safety
- Stay within designated areas aboard the vessel
6.2 Prohibited Items
The following items are not allowed on board:
- containers made of glass
- Illegal substances
- Firearms or weapons
- Excessive consumables (more than what is considered reasonable consumption)
- Pets (unless approval has been granted beforehand)
6.3 Conduct
Passengers are expected to behave respectfully. We hold the power to cease a charter prematurely with no refund if passenger behavior is unsafe or ruins the experience for others.
7. Liability and Insurance
7.1 Our Liability
We only accept liability up to the cost of your charter and not for:
- Injuries to oneself due to personal carelessness
- The loss or destruction of personal belongings
- Incidental, consequential, or punitive damages
- Delays because of weather or situations outside our control
7.2 Insurance Coverage
Our marine insurance is all-encompassing, securing our vessels and operations. Charterers are liable for their own travel and personal insurance.
7.3 Assumption of Risk
Engaging in our boating services implies acceptance of the intrinsic risks of maritime activities and responsibility for your safety and health.
8. Modifications and Itinerary Changes
We reserve the right to alter itineraries, courses, or timetables due to weather, security issues, or operational demands. We will make every effort to offer comparable alternatives should there be a change.
9. Force Majeure
We hold no liability for pauses, cancellations, or changes prompted by events beyond our control - examples include:
- Extreme weather
- Natural calamities
- Regulatory mandates
- Port shutdowns
- Mechanical malfunctions
10. Privacy and Data Protection
We handle your private details in line with our Privacy Policy. By engaging with our services, you approve the gathering and utilization of your data as described in our Privacy Policy.
11. Intellectual Property
The material on our website, such as text, visuals, logos, and images, is defended by copyright and intellectual property laws. Unauthorized reproduction, distribution, or creation of derivative content is not permitted without our explicit consent.
